1. Booking Conditions
•As ever, it is very important that You read and understand these terms and conditions as they form the basis of the agreement You are making with the owners of the rental properties ("the Owner/s"). By entering into this agreement, You confirm that You have read, understood and accepted these conditions.
2. Definitions
•'I', 'Us', ‘Our' and 'We' means Tots to Travel Limited and its nominated representatives, whose registered office is at Templars House, Lulworth Close, Chandlers Ford, Hampshire, SO53 3TL.
•'You' and 'Your' means You (and, as appropriate any and all persons in Your party), or visitors Using this Website (http://www.totstotravel.co.uk - "the Website").
•'Owner' and ‘House Owner' means the owner of the property/ies that You are booking and with whom You are entering into an agreement and to whom any obligations on You outlined in these terms and conditions are made. Details of the Owner are available on request before you enter into this agreement with them. Otherwise, you will receive full details of the Owner once full payment for Your booking has been received.
3. Making a Booking
•All bookings will taken over the telephone, or via e-mail or from the Website. If You contact Us by e-mail and provide a telephone number then We will respond by e-mail or telephone. If You prefer to be contacted by telephone, then please state this at the time of contact with a preferred time of day.
•We will Use reasonable endeavours to match Your requirements with the properties available, and once We have reached verbal or written agreement on the property You wish to rent, We will send You confirmation by e-mail. You should not enter into any other arrangements based on Your booking (such as ferry or flight bookings) until You have received a written or verbal confirmation from Us that the property is reserved for You for the dates You require. Bookings and payments will be handled by Tots to Travel as agent for the Owner; payments will be forwarded to the Owner on Your behalf minus the commission earned by Tots to Travel.
•A deposit of 30% of the full rental amount due under the agreement ("the Rental") is due on receipt of this confirmation. The full balance of the Rental payable becomes due 8 Weeks before Your departure date. Bookings taken within this 8 Week period require full payment on receipt of confirmation from Us. Payments made Using debit or credit card over the telephone or through the Website are not subject to any additional fees. SEPA payments received through bank transfer to our Euro account may be subject to a fee of £4.00 per transfer.
•If the deposit and subsequent balance are not received within 3 days of their respective due dates, the booking will be deemed to have been cancelled. Any deposit which has already been paid will not be refundable.
•In addition to the Rental, a refundable security deposit will be levied by the Owner and is payable to the Owner as directed in Your booking details. If the security deposit is not paid to the Owner, this will preclude entry to the property. The security deposit may be used to compensate Owners for breakages or non-payment for services payable locally. The Owner reserves the right to take funds from the security deposit where there is reasonable evidence of unreported breakages or damage. The rate of security deposit payable for each property is set by the Owner and is detailed in the property information table for each property and will be shown on Your booking invoice.
•Tots to Travel will not enter into any negotiation or arbitration between You and the Owner regarding the security deposit and any such discussions will be held directly between You and the Owner.
4. Cancellation and Changes to Bookings
•If You wish to change Your booking, then please contact Us at the earliest opportunity. Whilst We will use our reasonable endeavours to help You change Your booking, We cannot guarantee that all or any of Your requests can or will be accommodated. If Your change incurs extra costs, these will be added to the total Rental due at 8 Weeks prior to travel. If changes are made within this period, then payment will be due immediately, and confirmation of such changes will not be made until payment is received. We reserve the right to charge a small fee (£25) if required to cover administration costs associated with such changes.
5. Cancellation and Refund Policy
•If You wish to cancel Your holiday, then You should contact Us at the earliest opportunity. Once Your deposit has been received, it is non-refundable. This policy directly reflects the Owners' individual policies, and You should therefore take out suitable Travel Insurance to cover the risks that may lead to such an eventuality. Once full payment has been made, then this will also be non-refundable. We will make reasonable efforts to re-let the week/s that You have cancelled. If the property is successfully re-let by Us during the cancelled period, You will receive the Rental minus Your deposit and an administration fee of 10% for the extra work involved by Us. Your deposit will be retained by the Owner and shall not be refunded.
6. Travel Insurance
•We understand that with Young children, unforeseeable events may preclude You being able to travel at the last minute. You will also need significant Personal Liability Insurance when abroad which is not provided under the Owner's Property Insurance. For these reasons, it is a condition of booking that You take out adequate travel insurance before You travel; alternatively, annual insurance policies are often good value. We reserve the right to ask for proof of travel insurance before Your departure date especially to countries outside the EU. We can advise You on insurance if You wish. For travel within the EU, all members of Your party should have an EHIC card (formerly E111); for travel outside the EU, You should ensure that Your travel policy includes adequate medical cover including the cost of repatriation should it be required.
7. Local Tourist Taxes
•Please note that local laws sometimes dictate that a small tourist tax (for example the 'Taxe de Sejo
ur' in France) is charged locally.The collection of this tax is at the discretion of the local commune; You may therefore be asked to pay a small amount based on the number of people staying per night whilst You are at Your accommodation to cover this compulsory tax.
8. The Role of Tots to Travel
•Tots to Travel is an agent acting on behalf of the House Owners who are supplying accommodation to You. It is important to understand that by asking Us to undertake a booking on Your behalf, You are entering into an agreement with the House Owner and that You are liable to the House Owner and the House Owner to You.
•This arrangement has implications that You should be aware of. The extent of our liability to You is as set out in clause 9 below.
•Tots to Travel Ltd is registered for VAT in the UK under the Tour Operators Margin Scheme (TOMS) number 989 0092 78. All sums quoted include VAT at the current rate.
9. Liability of Tots to Travel
•As agents, We will always endeavour to ensure that Your holiday arrangements run smoothly, but We are not liable for the actions of the House Owners, their representatives or any person not employed by Us. Tots to Travel do not arrange Package Holidays as defined by the Package Travel Regulations 1992.
•We have visited all the properties advertised on our Website, and whilst We use reasonable endeavours to ensure that all descriptions of the properties are made in good faith and are accurate, We exclude liability for any inaccuracies, omissions or mis-descriptions of the properties or for Your subjective interpretation of any such descriptions.
•You will of course be informed of any last minute changes to items available, but We do not guarantee the accuracy of any of the items listed.
•If any problems occur on Your holiday, You may contact Us for assistance should the need arise, but We do not guarantee to be able to rectify any local problems either where this is the responsibility of the House Owner or where You fail to follow the complaints procedure outlined in clause 10 below. This service is offered at our discretion and We shall not incur any liability to You in this regard.
•Save as expressly set out above, all warranties, terms and conditions implied by law or otherwise are excluded to the fullest extent permitted by law.
•Tots to Travel Limited excludes all liability for any and all special, indirect or consequential losses, damages, costs or expenses suffered or incurred by You as a result of Your booking, Your stay at the property, or otherwise in connection with Your agreement with the House Owner.
•The total liability to You by Us or the House Owner in contract, tort and statutory law shall not exceed the Rental payable by You under the agreement.
•Nothing in this Clause 9 shall be deemed to exclude our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.
10. Complaints
•It is very important to Us and the House Owners that You enjoy Your holiday. If there is anything that gives rise to a complaint, then You must inform the House Owner or nominated representative as soon as possible. We do not accept any liability on behalf of the House Owner for problems arising with the properties and it is the Owner's obligation to ensure that the accommodation is provided to the required standard.
•We will however attempt to address any complaint You cannot immediately rectify locally as long as You contact Us as soon as possible and supply written confirmation of Your complaint to Us within a week of Your return. We offer this service to ensure a positive outcome to any problems that may occasionally arise and will use all reasonable endeavours to rectify a problem within 48 hours of being notified of the problem. This service is provided at our discretion and We shall not incur any liability to You in this regard.
•If a problem arises that cannot be rectified, We may, at our own discretion, with the consent of the Owner, offer to re-accommodate You in another property. If such an offer is made but not taken up by You, neither Tots to Travel Limited nor the Owner will subsequently be liable for any compensation payments to You.
•For the avoidance of doubt, Tots to Travel shall not be liable to You for the supply of the accommodation or facilities and services offered nor any and all special, indirect or consequential losses, damages, costs or expenses suffered or incurred by You as a result of any problems with the properties.
11. Force Majeure
•There are certain things that neither We nor the Owner can reasonably foresee and avoid. In these instances neither We nor the Owner accept liability for any loss, damage or inconvenience resulting to You, and will not be obliged to compensate You. Examples of such events include the breakdown of local services, plumbing, electrics, or problems with swimming pools, war or threat of war, civil strife or riot, terrorist activity or the threat thereof, natural disaster, Weather, fire, industrial dispute and all other events which are out of our control. Neither We nor the Owner can accept any responsibility for the closure or congestion of roads, ports or airports.
12. Your Responsibilities
In undertaking a booking through Tots to Travel you are undertaking the following obligations to the Owner:
•You undertake to behave in a proper manner; to avoid causing nuisance or annoyance to the Owner, neighbours or other holiday makers.
•You must arrange to pay the security deposit to the Owner as directed in your booking details.
•You are responsible for the actions and behaviour of the other members of Your party who are staying at or visiting the property during the rental period.
•Details of any pets must be given at the time of booking.
•You undertake to take good care of the property and its fittings and furnishings. Please treat the properties like they were Your own. You should leave all furniture, fittings and fixtures in the same position and condition as You found them on Your arrival. You are to leave the property in a very clean and tidy condition having reported any breakages or other problems to the nominated representative at the earliest opportunity.
•We understand that breakages do happen! Please do not replace broken items unless asked to locally. Inform the Owner at the earliest opportunity using the contact numbers you are given. Breakages will be treated on a case by case basis and costs, repair or replacement may be taken from the security deposit. If the cost of repair or replacement exceeds the amount of the security deposit, then You will be liable for the difference. Once again, You are strongly advised to seek adequate insurance to cater for such a situation. Please inform the local contact of any breakages as they happen.
•You will understand that the use of facilities such as swimming pools entails a certain risk. The Use of such amenities (including any sports and recreational equipment) is entirely at Your own risk, and due care and attention should be paid at all times. If a cover is provided it should be used when the pool is not in use; gates into pool enclosures should never be propped open.
•All swimming pools provided at the properties comply with the local laws, but this does not guarantee complete safety for very young children. Please supervise closely all activities in the vicinity of the pool. Children under the age of 14 should not be left unsupervised; there should be no diving or jumping onto floating toys from the pool side. Glassware should not be used near or adjacent to swimming pools. To maintain a high level of hygiene, young children and babies should wear swimming nappies if required and all users should shower before entering the pool. Pool heating systems vary and pool opening periods will also vary throughout the year - if Your booking is for one of the cooler months then please enquire whether the pool will be useable at the time of booking and We will do our best to find out for You. If the pool is described as being heated or open for a set period of the year, this does not guarantee a certain water temperature which will be entirely dependent on the prevailing weather conditions.
•If baby-sitting is offered, it is payable for locally in the local currency. The employment of baby-sitters is entirely at Your own risk and You should understand that We have not undertaken any vetting process nor do We specifically recommend any one individual. The availability of this service cannot be guaranteed and You should satisfy Yourself that You are happy to leave Your children in the care of another person.
•You undertake to ensure that no more than the maximum number of people listed on the particulars stay in the property. Tents, camper-vans and caravans are not permitted. Exceeding the maximum limit may invalidate local insurance and the owner reserves the right to refuse admittance to any additional persons found using the accommodation or amenities therein. You may also be liable to eviction with no right to compensation.
•You should not arrive before the specified time on Your day of arrival and You should ensure that You vacate the property before 10am on Your day of departure. Please ensure that the property is in a clean and tidy condition otherwise an extra cleaning charge may be levied or taken from Your security deposit.
•You should not use towels or linen supplied in the property outside. Please supply Your own towels for outdoor use unless these are specifically provided locally.
•You should not remove any protective mattress covers provided.
•You should pay the local tourist tax if requested by the local representative; this is not included in Your booking.
•You undertake to pay for all services and facilities Used locally where a charge is incurred for use.
•Where use of utilities and facilities are included (heating, electricity, gas, water, telephone, air conditioning etc) this is for reasonable use; excessive use of any service that leads to a significantly higher than normal cost falling to the Owner may result in a surcharge being claimed from the Security Deposit.
•The Owner may have additional Terms specific to the Property that You will be required to agree to; You will be informed of these before your holiday commences.
10. Use of the Website
•Nothing on this Website constitutes an offer on our part. All arrangements referred to are subject to confirmation.
•Travel times shown are approximate and are based purely on mileage; please ask for advice on travel to Your chosen property.
•Map locations are designed to show the area of the property at large scale and are not accurate when zoomed into smaller scales; directions to the property will be given after full payment is made for a booking.
•No part of this Website may be reproduced or used for any commercial Use.
•The Website may contain inaccuracies; it may at times be out of date. We retain the right to change any details shown with no notice. You must ensure that all details of Your chosen holiday arrangements are correct at the time of booking.
11. Governing Law and Jurisdiction
•These terms and conditions and Your agreement with the House Owners shall be governed by and construed in accordance with English Law.
•The English courts shall have exclusive jurisdiction over any disputes arising as a result of the agreement between You and the House Owners; and in respect of any matter in these terms.
