Agency Terms & Conditions

Except where otherwise specified, we Tots to Travel Ltd act only as an agent in respect of all bookings we take and/or make on your behalf. We accept no liability in relation to any contract you enter into or for the provision of any property rental or other services or arrangements you purchase (“arrangements”) or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any arrangements. For all arrangements, your contract will be with the supplier of the arrangements in question which in most cases will be the owner of the property you’re booking or their appointed agent locally (the ‘Owner(s)’).When making your booking we will arrange for you to enter into a contract with the applicable Owner of the arrangements. Your booking with us is subject to these Agency Terms and Conditions and the specific booking conditions of the relevant Owner you contract with and you are advised to read both carefully prior to booking. The Owner’s terms and conditions may limit and/or exclude the Owner’s liability to you. Copies of applicable conditions are available on request from us.

References to 'I', 'Us', ‘Our' and 'We' means Tots to Travel Limited and its nominated representatives, whose registered office is 8th Floor, Becket House, 36-37 Old Jewry, London, EC2R 8DD. References to 'You' and 'Your' means You (and, as appropriate any and all persons in Your party), or visitors Using this Website ( - "the Website").

By making a booking with us, you agree that:

  1. you have read these Agency Terms & Conditions and agree to be bound by them on behalf of yourself and all members of your party;
  2. you are over 18 years of age and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services.

Please carefully read the sections below:

All bookings will be taken over the telephone, or via e-mail or from the Website. If You contact Us by e-mail and provide a telephone number then We will respond by e-mail or telephone. If You prefer to be contacted by telephone, then please state this at the time of contact with a preferred time of day. If you provide us with a mobile phone number we may also contact you by SMS. If you contact us or reply to us by SMS please note that standard text message rates may apply.

We will Use reasonable endeavours to match Your requirements with the properties available, and once We have reached verbal or written agreement on the property You wish to rent, you must pay a non-refundable deposit as required by the Owner and specified to you at the time of booking (or full payment if booking within 10 weeks of departure) in order to confirm your booking. Upon receipt of this payment, we will send You a confirmation invoice by e-mail, on behalf of the Owner. The confirmation invoice will also be available on your online log-in area. Please note that your booking is only confirmed and a contract between you and the Owner only exists once we have issued you with a confirmation invoice. You should not enter into any other arrangements based on Your booking (such as ferry or flight bookings) until You have received this confirmation invoice.

Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. When completing your on-line booking form, please ensure that names are exactly as stated in the relevant passport. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.

As agent for the Owner, all monies you pay to us for arrangements will be held on behalf of the supplier(s) concerned; and payments will be forwarded to the Owner on Your behalf minus the commission earned by Tots to Travel.

In these terms, the Rental means the full rental amount due by You under Your contract with the Owner as notified to you at the time of booking. If you have paid a deposit, you must pay the full balance of the Rental by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the Owner who may cancel your booking. Please note that in these circumstances any deposit which has already been paid will not be refundable and this directly reflects the Owner’s individual policies.

In addition to the Rental, a refundable security deposit may be levied by the Owner and is payable to the Owner as directed in Your booking details. If the security deposit is not paid to the Owner, this will preclude entry to the property. The security deposit may be used to compensate Owners for breakages or non-payment for services payable locally. The Owner reserves the right to take funds from the security deposit where there is reasonable evidence of unreported breakages or damage or where additional cleaning is required if a property is left in a particularly dirty or untidy state. The rate of security deposit payable for each property is set by the Owner and is detailed in the property information table for each property and will be shown on Your booking invoice. The payment may be required in the local currency (Euros).

Tots to Travel will not enter into any negotiation or arbitration between You and the Owner regarding the security deposit and any such discussions will be held directly between You and the Owner.

  1. Tots monthly payment plan is available to use on selected properties featured on the Tots to Travel website only.
  2. You will be required to pay a deposit on confirmation of booking; the amount varies by property and will be confirmed to you.
  3. The final monthly payment must be made at least 10 weeks prior to the date of your departure.
  4. The balance of the total cost will be divided equally across the number of full months between payment of the deposit and the final payment date (being at least 10 weeks prior to your departure date).
  5. There are no additional costs or savings to use this service. The price of your holiday accommodation will be the same regardless of which payment method you choose to use.
  6. Tots to Travel reserve the right to withdraw or refuse the monthly payment plan at any time.
  7. The payment plan can only be used with a Credit Card or Debit Card and not cash, cheque or any other payment method.
  8. If for any reason payment is not received as part of the agreed plan, we will endeavour to contact you to let you know. However it is your responsibility to ensure that payment/s are received so that the balance is paid at least 10 weeks before the departure date.
  9. If a planned monthly payment is not made for any reason, the payment plan will be cancelled and the full amount remaining will be due at the normal time (10 weeks before departure).
  10. In the event of cancellation by you prior to 10 weeks before departure, any balance payments made on the Plan by you will be refunded (minus a £50 admin fee). Within 10 weeks to departure, the deposit and balance refund policy will be in accordance with the relevant accommodation Supplier Terms and Conditions.
  11. Please state that you wish to use the Monthly Payment Plan at the time of booking; it is not possible to use the Payment Plan once your booking has been processed.
  12. Standard Tots to Travel Booking Terms and Conditions apply.

Super Low Deposit for Winter Sun:

  • Only £99 per family available at Green Garden, Tenerife and Hyde Park Lane, Lanzarote
  • Final balance due 7 days before departure
  • For departures up to 31st January 2020 inclusive
  • Applicable for bookings made until 10th November 2019 inclusive
  • Only available to book by phone
  • Offer applies to new bookings only
  • Cancellations made 7 days or less prior to your departure date will incur 100% charge of the total booking cost. In addition, a £50 admin charge will be applied

The items on the Essential Kit Guarantee list belong in the property and must not under any circumstances be removed.

It is the responsibility of the guest to ensure that items on the list are left in the same condition that they are found.

If items on the list are found to have been removed or damaged a deduction from the security deposit will be made by the Owner.

In the event that an item listed is missing upon arrival it is the responsibility of the guest to inform the property owner at the earliest opportunity. The Owner will endeavour to replace the missing item using all reasonable effort to do so.

Neither Tots to Travel nor individual property owners can be held responsible for items damaged or removed by previous guests but property owners will endeavour to replace them upon notification by You.

In the case of a property complex it may be necessary for a guest to request items from the site manager so that they can be placed in your property prior to arrival.

Some owners prefer to operate DVD loan on request to avoid loss or damage without their knowledge.

Please note that the Essential Kit Guarantee items are not standard issue items. Whilst all items will be available at each property subject to these terms, the make and models of individual items will vary between property.

Any photography used to advertise the EKG is intended to act as a visual representation of the type of equipment in the EKG list and are not representative of the exact make and model that will be found at each property.

In some instances there will be good reason where items are not provided. These instances include but are not limited to:

  1. Stair gates will not be provided in properties that have no stairs
  2. Non-slip bath mats may not be provided in properties with no baths
  3. Where baby monitors incorporate a night light, a separate night light may not be provided.
  4. Where a power supply or space does not allow provision of a microwave

We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. You must check the price of your chosen arrangements at the time of booking.

Together with the unique benefits You receive by booking through us, we also want You to be confident that the prices shown are the best available.  Therefore where the same property (and any associated extras) are available elsewhere for a lower price, we promise to price match the lower price.  The following terms apply to the Price Match Promise:

The accommodation offered must be the same in all respects, including facilities offered, payment and cancellation terms
Inclusive items of equipment or services must be identical (often items such as cots, highchairs or pool fencing are charged as extras but are included in our price)
The accommodation must still be available to book at the time of the comparison.

Where our Sterling price is being compared to a Euro price, the published daily Post Office exchange rate will be used to convert and compare

The price match applies to accommodation only and not to additional services offered locally such as board options, childcare etc
The following are excluded from the Price Match Promise:

  1. Special Offers
  2. Prices that are only available as a result of discount, loyalty, staff or voucher schemes
  3. Prices that are conditional on buying other products (such as flights, transfers, travel insurance, board options etc)
  4. Ancillary costs such as credit card charges

Any claim must be presented before your booking is confirmed by us; currency fluctuations make it impossible to offer this promise once a booking has been confirmed. There may be a rare instance where we may not be able to Price Match; in this case you will be free to book elsewhere if you wish to

How to claim:

  1. Please contact the Family Holiday Expert who has been assisting you with your booking
  2. Include a link or screen grab to the alternative supplier showing the price offered, the accommodation details and dates
  3. We will verify the comparison is valid and discount our price accordingly if so
  4. If your claim is not valid then your booking can proceed under the standard Terms and Conditions

If you have any special requests (for example dietary requirements, cots or room location), please let us know at the time of booking. We will pass on all such requests to the supplier, but we can't guarantee that they will be met and we will have no liability to you if they are not.

If You wish to change Your booking, then please contact Us at the earliest opportunity. Whilst We will use our reasonable endeavours to help You change Your booking, We cannot guarantee that all or any of Your requests can or will be accommodated. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that such requests will be met. Amendments can only be accepted in accordance with the terms and conditions of the Owner. The Owner may charge the amendment charges shown in their booking conditions (which may be as much as 100% of the cost of the travel arrangements and will normally increase closer to the date of departure) and if Your change incurs extra costs, these will be added to the total Rental due at 10 Weeks prior to travel. If changes are made within this period, then payment will be due immediately, and confirmation of such changes will not be made until payment is received. In addition, we reserve the right to charge a small fee (£50) if required to cover administration costs associated with such changes. You will be notified of the exact charges at the time of amendment.

If You wish to cancel Your holiday, then You should contact Us at the earliest opportunity. Cancellations can only be accepted in accordance with the terms and conditions of the Owner, and not all Owners apply the same policy. Unless detailed otherwise on the specific property page terms and conditions or within additional terms supplied to You by the Owner, once Your deposit has been received, it is non-refundable. This policy directly reflects the Owners' individual policies, and You should therefore take out suitable Travel Insurance to cover the risks that may lead to such an eventuality. Unless detailed otherwise below, once full payment has been made, then this will also be non-refundable and again this directly reflects the Owner’s individual policies. We will make reasonable efforts to re-let the week/s that You have cancelled. If the property is successfully re-let by Us for the cancelled period, You will receive the Rental minus Your deposit and an administration fee of 10% of the total amount of your Rental for the extra work involved by Us. The amount you receive will be abated should the weeks sold by Us be at a discounted price which may sometimes be necessary if it is a last minute cancellation. Your deposit will be retained by the Owner and shall not be refunded in any circumstances. You will be notified of the exact charges at the time of amendment or cancellation.

Please refer to the individual property pages Terms and Conditions box for any additional or modified policies that may apply to that particular property.  In any case, a £50 Administration Fee may be applied by Us in the event of cancellation to cover the work required in processing it for You.

We will inform you as soon as reasonably possible if the Owner needs to make a significant change to your confirmed arrangements or to cancel them. We will also liaise between you and the Owner in relation to any alternative arrangements offered by the Owner but we will have no further liability to you.

We understand that with young children, unforeseeable events may preclude You being able to travel at the last minute. You will also need significant Personal Liability Insurance when abroad which is not provided under the Owner's Property Insurance. For these reasons, it is a condition of booking that You take out adequate travel insurance at the time of booking; alternatively, annual insurance policies are often good value. We reserve the right to ask for proof of travel insurance before Your departure date especially to countries outside the EU. For travel within the EU, all members of Your party should have an EHIC card (formerly E111); for travel outside the EU, You should ensure that Your travel policy includes adequate medical cover including the cost of repatriation should it be required.

Please note that local laws sometimes dictate that a small tourist tax (for example the 'Taxe de Sejour' in France, or the Ecotax in the Ballearic Islands) is charged locally.The collection of this tax is at the discretion of the local authorities; You may therefore be asked to pay a small amount based on the number of people staying per night before You arrive or whilst You are at Your accommodation to cover this compulsory tax.  You may not be granted access to Your accommodation unless this tax is paid.

Please note that you may be asked to provide a copy of your passport photo page to the Owner of the property at which you are staying; this is to fulfill their requirements under local laws.

Tots to Travel is an agent acting on behalf of the Owners who are supplying accommodation to You. It is important to understand that by asking Us to undertake a booking on Your behalf, You are entering into an agreement with the Owner and that You are liable to the Owner and the Owner to You. Tots to Travel is not a party to this agreement.

This arrangement has implications that You should be aware of. The extent of our liability to You is as set out in clause 12 below.

As agents, We will always endeavour to ensure that Your holiday arrangements run smoothly, but We are not liable for the actions or omissions of the Owners, their representatives or any person not employed by Us. Your contract is with the supplier and its booking conditions apply. As agent, we accept no responsibility for the actual provision of the arrangements. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for any information about the arrangements that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to the value of the Rental payable by you (or the appropriate proportion of this if not everyone on the booking is affected).

All the properties advertised on our Website have been visited by a representative of Tots to Travel, and whilst We use reasonable endeavours to ensure that all descriptions of the properties are made in good faith and are accurate, We exclude liability for any inaccuracies, omissions or mis-descriptions of the properties or for Your subjective interpretation of any such descriptions.

All descriptions and content on our website or otherwise issued by us is done so on behalf of the Owner and is intended to present a general idea of the services provided by the Owner. Not all details of the relevant services can be included on our website. All services shown are subject to availability.

Whilst the representatives of Tots to Travel take great care in their assessment of properties during their visit, they are not qualified nor warrant to undertake a formal Health and Safety assessment of the property nor of ancillary services, equipment and facilities such as Kids Clubs. Risks may be present of which they were not made aware or did not notice during their visit. It remains the full and sole responsibility of the property Owner to ensure that all local safety regulations are complied with and that safety related equipment (such as CO alarms and pool alarms) are maintained in good working order. The visit to a property made by Tots to Travel or its representative does not imply the acceptance of any liability for risks encountered at it and the responsibility for the safety and supervision of children remains Yours at all times.

We take particular care around swimming pool safety and describe pools as 'barriered'.  This word is used to describe the wide array of solutions that exist to prevent inadvertant access by children to open water including pool fencing, secure pool covers and also including a variety of other ways that create a barrier albeit not always around the pool itself.  Examples include where a part of a terrace adjacent to a property has been fenced off or in a resort or hotel where the accommodation has a secure front door and enclosed private balcony or outdoor area.  You should note that despite precautions taken to prevent inadvertent access that children should never be left unsupervised near water and that it is imperative to use safety feature such as gates and pool covers correctly.

You will be informed of any last minute changes to items available that We are made aware of by the Owner, but We do not guarantee the accuracy of any of the items listed.  Use of any of the equipment provided by the Owner (including Baby Monitors) is at Your own risk and You should ensure the satisfactory functioning of equipment before relying upon its use.

If any problems occur on Your holiday, You may contact Us for assistance should the need arise, but We do not guarantee to be able to rectify any local problems either where this is the responsibility of the House Owner or where You fail to follow the complaints procedure outlined in clause 13 below. This service is offered at our discretion and simply as a gesture of goodwill on our part and We shall not incur any liability to You in this regard.

Save as expressly set out above, all warranties, terms and conditions implied by law or otherwise are excluded to the fullest extent permitted by law.

Tots to Travel Limited excludes all liability for any and all special, indirect or consequential losses, damages, costs or expenses suffered or incurred by You as a result of Your booking, Your stay at the property, or otherwise in connection with Your agreement with the House Owner.

Nothing in this Clause 12 shall be deemed to exclude our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.

It is very important to Us and the Owners that You enjoy Your holiday. Because the contract for your arrangements is between you and the supplier, if there is anything that gives rise to a complaint, then You must inform the Owner or nominated representative as soon as possible. We do not accept any liability on behalf of the Owner for problems arising with the properties and it is the Owner's obligation to ensure that the accommodation is provided to the required standard. If you fail to follow this procedure there will be less opportunity for the Owner to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.

We will however attempt to address any complaint You cannot immediately rectify locally as long as You contact Us as soon as possible and supply written confirmation of Your complaint to Us within a week of Your return. We offer this service in an attempt to ensure a positive outcome to any problems that may occasionally arise and will use all reasonable endeavours to rectify a problem within 48 hours of being notified of the problem. This service is provided at our discretion and entirely as a gesture of goodwill and We shall not incur any liability to You in this regard.

For the avoidance of doubt, Tots to Travel shall not be liable to You for the supply of the accommodation or facilities and services offered nor any and all special, indirect or consequential losses, damages, costs or expenses suffered or incurred by You as a result of any problems with the properties.

It is your responsibility to check and fulfill the passport, visa, health and immigration requirements applicable to your arrangements. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change and you must check the up to date position in good time before departure. Non British passport holders, including other EU nationals, should obtain up to date advice on passport and visa requirements from the Embassy, High Commission or Consulate of the destination you are visiting.

Tots to Travel Ltd will not be liable or pay you compensation if our obligations to you are affected by any event which we or the Owner in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concerned ’s control. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure.

Nothing on this Website constitutes an offer on our part. All arrangements referred to are subject to confirmation.

Travel times shown are approximate and are based purely on mileage; please ask for advice on travel to Your chosen property.

Map locations are designed to show the area of the property at large scale and are not accurate when zoomed into smaller scales; directions to the property will be given after full payment is made for a booking.

No part of this Website may be reproduced or used for any commercial Use.

The Website may contain inaccuracies; it may at times be out of date. We retain the right to change any details shown with no notice. You must ensure that all details of Your chosen holiday arrangements are correct at the time of booking.

These terms and conditions apply to our use of any words, images, video, information or any other ‘user generated content’ (“Content”) that you upload, post or share using third party websites or platforms including but not limited to Instagram, Facebook, Pinterest, YouTube, and Twitter (the “Third Party Platforms”) and which we use on our website, in other marketing channels or in any Tots to Travel owned social media platforms (“Tots to Travel Media”).

If we would like to use your Content in any Tots to Travel Media, we will contact you on the relevant Third Party Platform to ask your consent to use your Content. We will ask you to reply to us with the hashtag #yestotsapproved. By giving consent to us in this way you agree to be bound by these terms and conditions as well as the terms of use of any relevant Third Party Platform.

By consenting to our use of your Content, you:

  • confirm that you are 18 years or older;
  • confirm that if children are depicted in the post, you are the parent/guardian with legal responsibility of any minors depicted in the post;
  • confirm that you own or otherwise control the rights to your post and any and all elements thereof;
  • confirm that you have the rights from any and all third parties appearing in such post to use their names, images or likenesses and any other third party-owned elements as necessary in and as part of your post;
  • confirm that your post does not infringe or violate the rights of any third parties, including, but not limited to, intellectual property rights, copyrights, trademarks, rights of publicity/privacy, patent, trade secret or confidentiality obligations;
  • acknowledge that your Content may appear in Tots to Travel Media and grant Tots to Travel and its affiliates a non-exclusive, worldwide, transferable, royalty-free, irrevocable, perpetual right and licence without compensation to use your Content as set out in these terms and conditions;
  • You waive any right to inspect and/or approve the finished work incorporating the content or the advertising copy that may be used in connection therewith or the use of which said finished work may be applied. Further, you waive any claims to royalties with regards to your content or our finished work.

These Agency Terms and Conditions and any matters arising from them are subject to and governed by English law and both parties agree to submit to the exclusive jurisdiction of the English courts in relation to any dispute, claim or other matter which may arise between us.

You accept that you must behave in a proper manner whilst staying at the Property; to avoid causing nuisance or annoyance to the Owner, neighbours or other holiday makers.

You must arrange to pay the security deposit to the Owner as directed in your booking details.

You are responsible for the actions and behaviour of the other members of Your party who are staying at or visiting the property during the rental period.

Details of any pets must be given at the time of booking.

You undertake to take good care of the property and its fittings and furnishings. Please treat the properties like they were Your own. You should leave all furniture, fittings and fixtures in the same position and condition as You found them on Your arrival. You are to leave the property in a very clean and tidy condition having reported any breakages or other problems to the nominated representative at the earliest opportunity.

We understand that breakages do happen! Please do not replace broken items unless asked to locally. Inform the Owner at the earliest opportunity using the contact numbers you are given. Breakages will be treated on a case by case basis and costs, repair or replacement may be taken from the security deposit. If the cost of repair or replacement exceeds the amount of the security deposit, then You will be liable for the difference. Once again, You are strongly advised to seek adequate insurance to cater for such a situation. Please inform the local contact of any breakages as they happen.

You will understand that the use of facilities such as swimming pools entails a certain risk. The Use of such amenities (including any sports and recreational equipment) is entirely at Your own risk, and due care and attention should be paid at all times. If a cover is provided it should be used when the pool is not in use; gates into pool enclosures should never be propped open.

All swimming pools provided at the properties comply with the local laws, but this does not guarantee complete safety for very young children. Please supervise closely all activities in the vicinity of the pool. Children under the age of 14 should not be left unsupervised; there should be no diving or jumping onto floating toys from the pool side. Glassware should not be used near or adjacent to swimming pools. To maintain a high level of hygiene, young children and babies should wear swimming nappies if required and all users should shower before entering the pool. Pool heating systems vary and pool opening periods will also vary throughout the year - if Your booking is for one of the cooler months then please enquire whether the pool will be useable at the time of booking and We will do our best to find out for You. If the pool is described as being heated or open for a set period of the year, this does not guarantee a certain water temperature which will be entirely dependent on the prevailing weather conditions.

Swimming pools are described on this website as having a 'barrier' to access which may mean the pool is physically enclosed, it has a weight-bearing retractable cover or net, or in the case of shared or community pools that access to the pool can be controlled by staying within the confines of the property itself or an alternative fenced or barriered area adjacent to the property from which You can control access. You should be aware that no barrier replaces the responsibility of the parent to supervise children in and around pools and to prevent access to them when it is not desired.

If baby-sitting is offered, it is payable for locally in the local currency. The employment of baby-sitters is entirely at Your own risk and You should understand that We have not undertaken any vetting process nor do We specifically recommend any one individual. The availability of this service cannot be guaranteed and You should satisfy Yourself that You are happy to leave Your children in the care of another person.

You undertake to ensure that no more than the maximum number of people listed on the particulars stay in the property. Tents, camper-vans and caravans are not permitted. Exceeding the maximum limit may invalidate local insurance and the owner reserves the right to refuse admittance to any additional persons found using the accommodation or amenities therein. You may also be liable to eviction with no right to compensation.

You should not arrive before the specified time on Your day of arrival (normally no earlier than 4pm for planning purposes so please enquire if You require an earlier arrival) and You should ensure that You vacate the property before 10am on Your day of departure. Please ensure that the property is in a clean and tidy condition otherwise an extra cleaning charge may be levied or taken from Your security deposit.

You should not use towels or linen supplied in the property outside. Please supply Your own towels for outdoor use unless these are specifically provided locally.

You should not remove any protective mattress covers provided.

You should pay the local tourist tax if requested by the local representative; this is not included in Your booking.

You undertake to pay for all services and facilities Used locally where a charge is incurred for use.

Where use of utilities and facilities are included (heating, electricity, gas, water, telephone, air conditioning etc) this is for reasonable use; excessive use of any service that leads to a significantly higher than normal cost falling to the Owner may result in a surcharge being claimed from the Security Deposit.

The Owner may have additional Terms specific to the Property that You will be required to agree to; You will be informed of these before your holiday commences.
